Promoter:

The Promoter of this Car Draw is Ability West, Blackrock House, Salthill, Galway. Ability West is a registered charity (CHY 6306).

Purpose:

The purpose of the Car Draw is to raise funds for the benefit of people supported through Ability West’s services. Ability West wishes to raise funds to fund capital projects. The organisers of the Car Draw shall not derive any personal profit from the Car Draw. All proceeds from the Car Draw will be applied exclusively for Ability West’s charitable purposes, including the support and delivery of capital projects.

Lottery Licence:

The Lottery Licence for this Car Draw was granted by the District Court in Galway on 6 January 2026.

Eligibility:

• By entering this Car Draw all entrants agree to be bound by these terms and conditions and any other conditions in the messaging or promotions of
  this Car Draw (which may be amended at any time by Ability West). Any entries not complying with these terms and conditions will not be valid.
• The Car Draw is open to all people worldwide aged 18 years or older.
  
• Members of the Car Draw/Fundraising Committee appointed to organise and oversee the Car Draw are expressly precluded from purchasing a Car Draw ticket.
• The promoter reserves the right to reject any entry (and award the prize to an alternative winner) if it has grounds to believe the entrant has breached
  any of these terms and conditions, acted fraudulently or illegally, or on other reasonable grounds and shall have no liability to an entrant for any loss or damage arising from such rejection.
• The promoter reserves the right to cancel, postpone, amend, terminate or temporarily suspend this Car Draw at any time with no liability to any
  entrant or any third party. If due to unavailability of a particular prize, beyond the promoter’s control, the promoter reserves the right to substitute a particular prize for another prize of similar value.
• Ticket sales will close on Monday, 29 th June 2026.

Ticket Information:

• The cost of a single Car Draw ticket is €10.00 or four tickets for €25.00 and 10 tickets for €50.00.
• There is no limit to the number of tickets an individual or group may purchase.
• Once purchased, tickets are non-refundable, except in circumstances where the Car Draw is cancelled by the Promoter. In such an event, a maximum refund of 90% of the ticket cost will be issued to the ticket holder.
• Tickets must be retained as proof of purchase.
• The Promoter accepts no responsibility for entries or ticket information that is lost, misplaced or not received.

Prizes:

• The First Prize is a Kia Picanto (hereinafter referred to as “the Car”) with a value at the date of this TOR of €20,995.
• The prize is as stated – no cash or other alternatives will be offered.
• The prize is non-transferable.
• The winner will be required to provide proof of identity when collecting the prize.
• The Promoter reserves the right to add additional prizes to the Car Draw. Any such additions will be announced to ticket holders as soon as practicable and published on the winakiapicanto.ie website.
• Along with the top prize of a car other prizes are:

 – 2nd Prize – Cash Prize €750 – sponsored by Castlelough Corporation Ltd.
 – 3rd Prize – 2 night stay in the Clifden Station House Hotel for 2 people with dinner for 2 x 1 night – sponsored by Clifden Station House Hotel, Clifden
 – 4th Prize – €500 Home Heating Oil Voucher – sponsored by Sweeney Oil
 – 5th Prize – Cash Prize €250 – Sponsored by Castlelough Corporation Ltd.

Car Draw Details:

The Car Draw will take place at St. Joseph’s Training Centre, Snipe Avenue, Newcastle, Galway H91 W2FT on Monday 29 th June 2026.

The Draw will also be broadcast live on Facebook and adjudicated by an external independent adjudicator.

The Promoter reserves the right to alter or change the date of the Car Draw for any reason. Any such change will be notified to ticket holders as soon as practicable via the email address used to purchase the ticket(s).

The winner will be selected at random from all valid entries.

Winner Notification:

• The winner will be announced within 28 days of the Draw on the winakiapicanto.ie website, Facebook, and Instagram and such other mediums of publication deemed appropriate by Ability West and including on digital platforms and promotional materials.
• The winner will then be contacted by the Ability West fundraising team.
• If the team fails to make contact, the winner must reach out to the Promoter via email, post, or in person at the Promoter’s registered office.
• The winner may be subject to verification by the Promoter. This process may take up to seven days to complete once the winner has claimed their prize.
• If the winner does not respond to notifications within 14 days, the Promoter reserves the right to select an alternative winner.
• The winner must collect the prize within 30 days of being verified, unless otherwise agreed with the Promoter.

Publicity:

By entering the draw, entrants consent to the use of their name for promotional purposes if they win. The winner’s name may appear on digital platforms and promotional materials. Ability West respects and is committed to protecting your privacy. The personal information you provide will remain private and will only be used for the purposes outlined here.

Liability:

Neither the Promoter nor any of its servants, agents, licensees, trustees, committee members, or organisers shall be liable to any ticket holder for any
loss, inconvenience, damage, or expense arising from participation in the Car Draw. Nothing in these Terms and Conditions shall exclude or limit the
Promoter’s liability for negligence, fraud, or any other liability which cannot be excluded by law.

Data Protection:

For the purposes of data protection legislation:

• The organisation will retain and use the car ticket purchaser’s personal data for the duration of the Draw and a reasonable period thereafter in
• compliance with data protection laws and regulations.
• On purchasing a car ticket, the car ticket purchaser agrees to their details being used solely in connection with the Draw. Personal data of any kind will not be disclosed to a third party without the ticket purchaser’s consent, except where required by law or regulation.
• The prize winners hereby agree and consent to the use of their personal data and/or image being released in publicity material in conjunction with the Draw, in compliance with data protection laws and regulations.
• The first prize winner of the car agrees and consents to their personal data being released to relevant third parties to enable the provision of the car to them, in compliance with data protection laws and regulations.

Governing Law & Jurisdiction:

These terms and conditions herein are governed by Irish Law and the parties submit to the exclusive jurisdiction of the Irish Courts.
